President Donald Trump was personally involved in discussions within the administration to potentially suspend Habeas Corpus, a legal procedure that allows people to challenge their detention in court, two people familiar with consideration told CNN.

One of Trump’s best aids, Stephen Miller, confirmed publicly on Friday that the administration “actively envisaged” the suspension of Habeas Corpus, adding that “depends on the question of courts or not”.

Miller’s private discussions and public comments show that this is seriously into consideration inside the West wing.

Although Trump did not explicitly mention Habeas Corpus in public, this is what he was referring to last month when he commented on the measures he could take to fight against national injunctions against his actions on deportations, according to one of the people familiar with talks.

“There are ways to mitigate it and there are very strong ways,” Trump told journalists on April 30. “There is a way that was used by three very respected presidents, but we hope that we will not have to follow this path. But there is a success successfully used by three presidents – all very respected – and I hope that we will not have to go in this way, but there are ways to mitigate it.”

It is not yet known if it is something that the administration will really pursue, and the experts say that it will probably generate legal challenges. The White House refused to comment beyond Miller’s statement.

“Essentially, everything Miller says about the suspension of the Habeas corpus – which would eliminate the ability of courts to reign on immigration issues – is wrong,” said Elie Honig, Senior Legal Analyst of CNN and former federal prosecutor.

“The Constitution clearly indicates that the suspension of the Habeas Corpus must be reserved for a rebellion or a real invasion posing the most disastrous threats of public security. And the Congress has never adopted a law authorizing deportations without any involvement of the courts, as Miller suggests. ”

The Constitution authorizes the suspension of Habeas Corpus only when “in the event of rebellion or invasion, public security may require it”.

Miller’s comments are taking over the Trump administration’s efforts to use the current state of illegal border crossings to affirm that the United States is under invasion – which, according to the administration, allows the government to avoid the protections of the regular procedure granted to migrants. The administration makes a similar argument in the defense of the invocation by Trump of the Act respecting extraterrestrial enemies, which would allow the government to quickly expel migrants without adherence to such procedures of regular procedure.

Several judges, including one person appointed by Trump, have rejected the invocation, claiming that in the decisions that the administration had not shown that the United States was under invasion by a hostile foreign power, as a largeness by virtue of the 18th century status.

Trump administration has also examined if he can label some cartel and gang members inside the United States as “enemy fighters” as a possible means of holding them more easily and complicating their ability to challenge their imprisonment, CNN previously reported.

The suspension of the brief of Habeas Corpus would take even more the efforts of Trump – allowing the government to hold migrants without giving them the opportunity to challenge this detention, essentially leaving administration to hold people without justifying.

“The brief of Habeas Corpus has been suspended on several occasions, but only in wartime or a real invasion, said a little,” said Ilya Somin, professor of law at George Mason University, CNN in January.

Although the Constitution does not explicitly require the approval of the Congress for such suspension, it has been understood for a long time that the Legislative Assembly should probably play this role, as noted by the late conservative judge Antonin Scalia in a dissent.

Somin said that some states also tried to claim, from the 1990s, that illegal immigration was equivalent to an invasion that would allow them to engage in war or ignore the federal laws that restrict the application of immigration.

“Whenever the courts ruled on this subject, they have ruled against the states,” said Somin.

Trump administration officials have clearly said they believe that the judicial branch hinders their ability to enforce immigration laws. President Donald Trump personally attacked judges in public statements, and Miller compared court decisions against the administration to a “judicial coup”.

In a sign of increasing pressure, the chief judge John Roberts stressed the importance of judicial independence during public remarks on Wednesday.

“The judiciary is a branch of coequal government, distinct from others with the power to interpret the constitution as law and to dismantle, obviously, acts of the Congress or the acts of the president,” said Roberts at a native buffalo event, New York.

The role of the judiciary, added Roberts, is to “decide on business but, during this, to verify the excesses of the congress or the executive”.
