The court learned that Somers was in a cell in May 2011 for violating the conditions for release under bail when he attacked Barry Stewart.
The 60 -year -old man was arrested after omitting a fine to drive by public transport without paying the price.
Somers and Stewart were assessed as having mental health problems and the recommendation was for a special unit to adapt to this, but there was no room, so they were placed together after consultation with a psychologist.
Stewart was sleeping on the ground when Somers got on a concrete bench and jumped with both feet on Stewart’s head.
Somers’ trial was informed that the accused trampled at the head of Stewart 26 times before being arrested by the guards. It was considered in a psychiatric assessment as a possible risk for others.
