The decision does not result in any immediate change regarding elite admissibility. The guiding bodies are not now obliged to modify or reconsider their rules.
The weight of the decision is likely to influence the development of policies over time and can lead to more sports prohibiting transgender women to compete with the categories of women.
“There are still a lot of unknowns here,” said Dr. Sema Patel, an associate professor in sports law at the Nottingham Law School.
“Many sports guidelines already have ineligibility for transgender athletes, so I don’t know if it will change a lot given the current state of play.
“I think the impact will be determined by the level of research and resources that the government wishes to put in this area to understand the sporting context.”
Many sports have introduced new policies concerning transgender athletes in recent years following certain high -level cases.
In 2023, British Cycling prohibited transgender women in the women’s category after Emily Bridges, a high -level transgender cyclist in the country, was prevented from participating in his first elite women’s race.
Last year, more than 100 British sports Elite told BBC Sport that they would be uncomfortable with transgender women who participate in female categories in their sport.
Many of them have expressed fears of publicly sharing their opinion due to concerns that they would be considered discriminatory.
One said to the BBC “your career is over” if you speak on the subject, while another said: “You can receive abuse if you support or do not support it. Damné if you do, damn if you don’t.”
The former British swimming champion and an oiympic silver medalist, Sharron Davies, was a vocal critic of transgender women who participate in sport.
“I am obviously extremely happy,” she said.
“I have been fighting for fair sport for women for 10 years against this absurdity that biological reality does not exist and that does not affect something like sport, so it was a very good day.
“I think it is really important that we can define what a woman is and that biology exists and that you cannot change your sex as human beings.
“This does not mean saying that we cannot respect people from all over society, but they want to introduce themselves, and it had never been my position that everyone should not be involved in sport.
“Let us now hope that all sports, including the FA (Football Association) and the ECB (English Cricket Board), will do it and they will stop discriminating about women and girls.”
