A default notice to the city of Norman was filed concerning the Rock Creek Entertainment District project.
According to the opinion, which was filed on April 24, if the Norman Tax Interest Authority does not approve of the phasing plan by May 24, the city could be continued.
“If the measures are not taken on May 20, the agreement may be by default; the appeals provided for the defect may depend on what is decided in court and may include termination of the agreement and / or damage and / or equitable rescue,” the city prosecutor Rick Knighton on Thursday wrote in an email or daily.
A default notice is an official legal document filed with a court or a public file office to indicate that a party has not complied with its obligations under the contract.
On April 22, the Norman municipal council postponed vote on the phasing plan For Rock Creek Entertainment District on May 20. At the meeting, Knighton told the Council that they would probably receive a default notice after postponing the vote.
“If you postpone this article until May 20, … I provide that you will get a default contract notice that would give you until 24,” said Knighton. “So, if you come back on the 20th and consider the question, that would not have caused a defect in this contract.”
Knighton said the phasing plan is a problem separate from the petition.
“I understand that there is a certain concern about the unanswered question with regard to the referendum petition. My comment on this subject would be a completely distinct problem. … This will have no impact on the way this case will be resolved,” said Knighton.
Mayor Larry Heikkila, the member of the district of district 1 Austin Ball, the board member 8 Scott Dixon and the member of the 6 Joshua Hinkle council voted against postponement.
