By the authority left in me as president by the Constitution and the laws of the United States of America, and in order to establish an advisory council on science and technology, it is by the present as follows:
Section 1. Objective. American history is a limitless creativity and a daring ambition, motivated by an indomitable pioneering spirit which propels exploration and discovery. It was this spirit that illuminated the world with the Edison bulb, wore the Wright brothers in the sky and sent Armstrong to the moon. Today, a new border of scientific discovery is ahead of us, defined by transformative technologies such as artificial intelligence, quantum IT and advanced biotechnology. The breakthroughs in these areas have the potential to reshape the global balance of powers, to completely eliminate new industries and to revolutionize our way of living and working. While our global competitors rush to exploit these technologies, it is imperative national security for the United States to carry out and maintain undisputed and undisputed global technological domination. To secure our future, we must exploit the full power of American innovation by empowering entrepreneurs, by unleashing the creativity of the private sector and by reinvigorating our research institutions.
At the heart of scientific progress is the continuation of the truth. But this fundamental principle, which has led to all the major breakthroughs in our history, is increasingly threatened. Today, through science, medicine and technology, ideological dogmas have surface that increase the identity of the group above individual success, apply conformity to the detriment of innovative ideas and inject politics at the heart of the scientific method. These agendas have not only distorted the truth, but have eroded public confidence, undermined research integrity, stifled innovation and weakens the competitive advantage of America.
This ordinance establishes the Council of President’s advisers on science and technology to unite the brightest minds in the academic world, industry and government to guide our nation through this critical moment by translating a path to follow for the American leadership in science and technology.
Second. 2. Establishment. (A) There is by this the Council of the President of the Advisers on Sciences and Technology (PCAST).
(b) The PCAST must be composed of more than 24 members. The assistant of the President of Science and Technology (APST) and the Special AI and Crypto Advisor will be members of the PCAST. If he is also director of the Science and Technological Policy, the APST can designate the director of American technology as a member. The other members are individuals and distinguished representatives from sectors outside the federal government appointed by the president. These non -federal members have various perspectives and expertise in science, technology, education and innovation.
(c) The APST and the Special AI and Crypto advisor will serve as co -channels from the PCAST. The co-chairs can designate up to two vice-presidents of the PCAST among the non-federal members of the PCAST, to support the co-chairs in leadership and the organization of the PCAST.
Second. 3. Functions. a) The PCAST advises the president on questions involving science, technology, education and innovation policy. The Council will also provide the president with scientific and technical information necessary to shed light on the public policy relating to the American economy, the American worker, national and interior security and other subjects.
(b) The PCAST meets regularly and must:
(i) respond to the requests of the president or co -presidents to obtain information, analysis, evaluation or advice;
(ii) request information and ideas of a wide range of stakeholders, including the research community; the private sector; Universities; national laboratories; States governments, local and tribal; Foundations; and non -profit organizations;
(iii) serve as an advisory committee identified in article 101 (b) of the 1991 law on high performance computer (public law 102-194), as modified (15 USC 5511 (b)), to which the PCAST must be known as the President Innovation and Technology Advisory Committee; And
(iv) serve as an advisory committee identified in article 4 of the law on research and development in nanotechnology of the 21st century (public law 108-153), as modified (15 USC 7503), to which the PCAST will be known as the national nanotechnology consultation panel.
(c) The PCAST must provide advice from the non -federal sector to the National Science and Technology Council (NSTC) in response to the NSTC requests.
Second. 4. Administration. (a) Heads of departments and executive agencies must, to the extent allowed by law, provide the PCAST information concerning scientific and technological issues when requested by PCAST co -presidents and, as needed, in order to perform the functions of the PCAST.
(b) In consultation with co-chairs, the PCAST is authorized to create standing sub-commies and ad hoc groups, including technical consulting groups, to help the PCAST and provide preliminary information directly to the PCAST .
(c) In order to allow the PCAST to provide advice and analyzes concerning classified questions, co -chairs can ask the members of the PCAS Receive determinations of safety and access release in accordance with executive decree 12968 of August 2, 1995 (Access to classified information), as modified, or to any successor order.
(d) The Ministry of Energy must provide this funding and administrative and technical support as the PCAST may require, to the extent allowed by law and as authorized by existing credits.
(e) PCAST members serve without any compensation for their work on the PCAST, but can receive travel costs, including journalists instead of subsistence, as authorized by law for people used by intermittently in the government service (5 USC 5701– 5707).
f) Insofar as the law of the federal advisory committee, as it has changed (5 USC.), may apply to the PCAST, all the functions of the president under this law, except that of report to congress , will be executed by the Energy Secretary, in accordance with the directives and procedures established by the Administrator of the General Services.
Second. 5. Termination. The PCAST must terminate 2 years from the date of this order unless the president has extended by the president.
Second. 6. Revocation. Executive decree 14007 of January 27, 2021 (Council of the President of the Advisers on Sciences and Technology), as modified by the Executive Decree 14109 of September 29, 2023 (continuation of certain federal council committees and modifications to other decrees) , is revoked.
Second. 7. General provisions. a) Nothing in this order should be interpreted as altering or otherwise affect:
(i) the authority granted by law to an executive department or to an agency, or at its head; Or
(ii) the functions of the director of the management and budget office relating to budgetary, administrative or legislative proposals.
(b) This order must be implemented in accordance with the applicable law and subject to the availability of credits.
(c) This order is not intended to create and create a right or advantage, a noun or procedure, enforceable in law or equity by a party against the United States, its departments, agencies or entities, Its officers, employees, or agents, or any other person.
